The Director of the Department of Small and Local Business Development (“Director”), pursuant to the authority set forth in Mayor’s Order 2021-124, dated October 14, 2021, and Section 4(i) of the Public Restroom Facilities Installation and Promotion Act of 2018 (“Act”), effective April 11, 2019 (D.C. Law 22-280; D.C. Official Code § 10-1053(i)), hereby gives notice of the intent to adopt the following new Chapter 105 (Public Restroom Incentive Pilot Program) of Title 29 (Public Welfare of the District of Columbia Municipal Regulations (“DCMR”), in not less than thirty (30) days after the publication of this notice in the D.C. Register.
Section 4 of the Act established a Community Restroom Incentive Pilot Program (“Pilot Program”), to be administered and enforced by the Mayor, and to provide funding, pursuant to rules issued by the Mayor, to participants that make their restrooms available free of charge to any person, regardless of whether the person patronizes the business. Pursuant to Mayor’s Order 2021-124, the Mayor delegated her authority under Section 4 of the Act to the Director. This proposed rulemaking details how the Department of Small and Local Business Development intends to administer and implement the Pilot Program.
